MP requests loss in favor of the State worth over 130 contos in trafficking and associated crimes case

The Public Prosecutor’s Office (MP) requested the forfeiture of 131,200 escudos and seized assets in favor of the State as part of a case involving thirteen defendants, accused of crimes related to drug trafficking, criminal association and other serious offenses.

As reported by the Public Prosecutor’s Office (MP) this Tuesday, on September 18, 2024, the investigation was closed, the accusation was filed and the trial was requested in Ordinary Common Process, before the Single Court, for the implementation of responsibility criminal offense of thirteen defendants.

Seven of these defendants were accused of material co-authorship and real or actual participation in a crime of criminal association for trafficking, two crimes of kidnapping and an aggravated weapons crime, foreseen and punished by national criminal legislation.

Three defendants were charged with co-authorship and in real or actual competition of a high-risk drug trafficking crime and a crime of criminal association for trafficking and a crime of aggravated robbery, foreseen and punished by national criminal legislation.

According to the same source, a defendant was accused of being responsible for an aggravated high-risk drug trafficking crime, foreseen and punished by national criminal legislation.

One defendant was charged with material authorship of a high-risk drug trafficking crime, foreseen and punished by national criminal legislation and another defendant was accused of material authorship of a weapon (ammunition) crime, foreseen and punished by national criminal legislation .

The Public Prosecutor’s Office ordered the partial archiving of the files, regarding the evidence of the crime of twelve defendants, since, during the investigation, not enough evidence was collected to verify the crimes of which they were accused, and one defendant, who died during the instruction phase.

However, it requested the maintenance of the coercive measures previously applied to the defendants, with eight defendants remaining in preventive detention, as the assumptions that determined their application remained unchanged.

The Public Prosecutor’s Office also requested that the sum of 131,200 escudos be declared lost in favor of the State, as well as some other materials seized from some defendants.
