The Provincial Court of Huelva has sentenced a man to two years in prison and five years of probation for sexually abusing a minor under 15 years whom he knew from going out, sometimes in a gang, during a night out.
The sentence of conformity considers him responsible for a crime of sexual abuse, with the mitigating circumstance of repairing the damage being very qualified, since the accused entered the court’s appropriations account. the amount of 10,000 euros as payment of compensation in favor of the victim.
In addition to the prison sentence and the supervised release measure, absolute disqualification is imposed, special disqualification for any profession or trade, whether paid or unpaid, that entails regular and direct contact with minors for a period of 7 years and a restraining order and communication with the victim for a period of 10 years.
It is declared proven that the accused, of legal age, on January 4, 2022, went to a party with some friends, where he coincided with the 15-year-old minor, to whom I knew of going out together in a gang sometimes.
During the party that lasted until the early hours of January 5, the defendant danced on several occasions with the minor and even they kissed in the bathroom of the place where the party was being held.
Next, the defendant got into his car with the minor, motivated by sexual interest, and took her to a remote place in town, where he touched her, he forced her to perform fellatio and finally he penetrated her even though she on several occasions expressed her refusal to allow him to do so.
Once the sexual act was over, the man got out of the car to vomit and the minor took the opportunity to communicate with a friend of yours through WhatsApp from your mobile phone and tell him what happened. Later, the defendant left the minor at the entrance to the town, who returned to the party, where she told several of her friends what happened.
As a result of the events, the minor has experienced changes in her academic career, has difficulty falling asleep and is in psychological treatment with a therapist.
